Regulatory Environment Surrounding Encryption

Governments all over the world, including the U.S. government, have concerns about the use of encryption. This concern manifests itself in a range of regulatory challenges to the technology that limit or restrict its use. The concerns, and therefore the regulations, differ from nation to nation. One example of this comes from the early years of encryption in the United States. Diffie-Hellman and the guys at RSA came up with the mathematical foundations for today's symmetric encryption solutions in the late 1970s. The NSA tried to block this research from being published because they felt it was a threat to their oversight of security matters. In the meantime, the barriers to research and the patent laws that favored offshore development caused a number of researchers in foreign countries to put their attention to potential technologies. Among those were PGP, or pretty good privacy. By the early 1990s the United States Congress, at the behest of the NSA and other intelligence agencies, were casting about for regulations that could restrict the impact of encryption, including a requirement that anyone manufacturing an encryption-based technology create a backdoor into their solutions or engage in 'key escrow' where the keys to an encryption algorithm would be held by a neutral third party. This controversy and the reaction to it is comparable to the more recent fight over the SOPA (Stop Online Piracy Act) rules, over which Internet providers and users pushed back at Congress.

Students will conduct a brief literature review on their assigned topic in policing. Your paper should be about 5-7 pages, not counting the cover page and reference page.

Your literature review must include three academic journal articles. (More sources are acceptable.) Each source must be published in a scholarly journal – peer-reviewed and must have been published in 2010 or more recently. Exceptions to the date may be made if the professor’s approval is sought and there is a legitimate reason for the date exception. In addition, your literature review must include the President’s Task Force on 21st Century Policing, and the specific sources provided to your group by Dr. Weisel.

The three academic articles you select must be a source which you and only you use for this assignment. To “claim” articles, student must post the source on Blackboard – Discussion Board. Only the first student to post the source may use it.

This literature review is the initial component of your project this semester – The project begins with a literature review, identifying the contributions of published research and theory, and lays the groundwork for further research – How are large police departments in North Carolina performing on this recommendation.

In future papers, you will develop a research design and methodology specifying the agencies from which you will, first, collect (existing) data and, second, develop a data collection instrument such as an interview protocol and collect data (guided by the professor). The final paper will culminate with a synthesis of these papers, in which you present your findings discussing how well are North Carolina police departments doing in achieving the recommendation.

This may be new technology, existing technology, training, or workflow changes. The solution must be fully developed, and supported with an implementation plan.
