  1. According to the text, crime has been part of the human condition since people began to live in groups. Ancient documents indicate that conduct we now call murder, theft, or robbery was identified as criminal by civilizations that existed thousands of years ago. Criminal laws regulate human conduct and tell people what they can and cannot do and, in some instances, what they must do under certain circumstances. In this assignment, you will explore different types of criminal conduct and the goals of criminal law.
    Write a four to six (4-6) page paper in which you:
    1. Determine whether or not a conviction is feasible when an alleged perpetrator does not have the required mens rea but has engaged in the actus rea. Provide a rationale to support your position.
    2. Explain the distinction between diplomatic immunity and legislative immunity. Next, support or criticize the premise that diplomatic immunity is vital for Americans abroad.
    3. Argue for or against the theory that the courts should not hold a defendant of questionable competency to the standard sentencing guidelines. Provide a rationale to support your response.
    4. Identify the four (4) goals of criminal law, and discuss the manner in which these four (4) goals effectuate the purpose of protecting the public and preventing the conviction of innocent persons.
    5. Use at least three (3) quality academic resources in this assignment. Note: Wikipedia and similar type Websites do not qualify as academic resources.

Larry Landlord has recently renovated an apartment and has put it on the market to be rented for $800.00 a month. Larry Landlord has been in business for approximately five (5) years and has had both positive and negative experiences with tenants. Larry Landlord is hoping to find a good, long-term tenant for his apartment. Roger Renter saw Larry’s sign for the apartment for rent and thought the location and the apartment would be perfect. Roger met Larry to look at the apartment and Roger fell in love with it. All of the interior fixtures had been replaced and the unit had a nice large closet. Roger noticed that although newly painted, the exterior of the apartment did show a little bit of wear. Because of the condition of the exterior of the building, Roger asked Larry about any roof leaks. Larry stated that he had never had a leak and was not aware of any leaks.

Roger and Larry entered into a valid contract for the rental of the apartment. (Note: The issue of whether or not a contract exists is NOT part of this question. For purposes of this question assume the contract is valid and there are no issues with the contract.)  

Roger Renter was very happy in his new location; the apartment was quiet and the neighbors were friendly. Larry Landlord was also very happy because Roger Renter was a model tenant. Roger Renter paid on time and was quiet and respectful to other tenants.

The part of the country where Roger rented was rainy in the summertime. Roger rented and moved into the apartment in October. In June, a tremendous rainstorm occurred and Roger’s roof began to leak. The leak was minor at first and Roger merely put a trash can under the leak and had no other issues that month. When handing over his monthly rent check, Roger told Larry about the small leak. Larry thanked Roger for letting him know about the leak and told Roger he would have it fixed. 

The next month the rains came again and the leak grew larger in Roger’s apartment. Roger was not home at the time of the rain and therefore the leak damaged some of Roger’s furniture. Roger called Larry to let him know that there was a leak and asked when it might be fixed. Roger also stated that he thought Larry had fixed the roof. Larry curtly stated, “When it rains, sometimes it pours. When it pours, sometimes it leaks.” Roger did not like Larry’s tone or response and called back to ask when the roof might be fixed. Larry stated, “When I get to it.” The following day, Roger sent Larry a note about the roof leak and asked Larry to please address the issue.

The week before the rent was due, another rainstorm occurred and the leak was even larger. This time the leak damaged Roger’s clothing, furniture, and some precious items he had inherited from family members. Roger called Larry and asked Larry to fix roof immediately. Larry responded in a similar and condescending manner. Roger hung up the phone and threw his baseball bat against the wall, damaging the drywall and knocking out an electrical socket.  

Since it was the rainy season, Roger knew it would rain again and therefore simply moved his items away from the leak and did nothing to help mitigate the damage from the leaking roof.

Larry came into the apartment to investigate the leak and found damage from not only the leak but also from the thrown baseball bat. Roger states that the baseball bat damage was a direct result of Larry’s inability to fix the leak based on his anger from Larry’s curt response. 

Suppose you are a mediator. In five to seven (5-7) pages discuss the rights and responsibilities of the landlord and the tenant in which you:

  1. Explore the legal rights and responsibilities of the tenant and the landlord. 
  2. Decide whether or not the landlord and / or the tenant had a legal duty to mitigate damages. 
  3. Determine whether or not Larry has legal grounds to evict Roger. Explain why or why not.  
  4. Describe whether or not Roger has a legal obligation to pay for the damage he caused and determine whether or not Larry would be liable for any direct damage. 
  5. Support each response with facts presented in the scenario.
  6. Use proper legal terminology throughout your responses.

    Scenario II—Second Amendment

    You accepted a job with Generic Hospital located in your city. The hospital is part of the Well Care system of for-profit hospitals. The employee handbook prohibits employees from possessing firearms on any company property. Generic Hospital is located in an area of town that is known for high crime rates, and you work the second shift, which means you will be leaving work late in the evening. You have a permit to carry a firearm in your car and believe the handbook’s provision violates your rights.

    • Summarize your state's parking lot laws related to firearms.
    • If you challenge your employer, which party will prevail? Provide arguments for both sides, determine which party wins, and provide support for your decision.

    Sullivan, a student at Shelby County Middle School, learned he received a D in English, which meant he would be required to attend summer school. While in the school library, Sullivan posted on Facebook that his English teacher should be shot. Sullivan also posted a cartoon that showed the teacher's head on a bloody dead body. Three days later, Sullivan's mother instructed her son to remove the post. Before the post was removed, a student printed the post and showed it to the principal, who suspended Sullivan for the last two weeks of school. Law enforcement was not involved in the situation.

     

    Determine whether Sullivan's statement and the resulting action by the school violate the First Amendment.

    Facts

    Our client was returning to a party to retrieve his car keys.  He had consumed a little alcohol at the party.  It was past 1:00 AM, and it was dark on the street where he had been at the party. The houses on the street were very similar in appearance.  Client walked around the back of the house where he thought the party was going on. It was the wrong house. In the darkness, he tripped over a German Shepherd sleeping behind the house.  The dog got mad and bite the client on the leg.

    Directions:

    Answer the following questions applying the statutory and case law provided. 

    Use rule-based and analogical reasoning and present your thoughts in unified, coherent paragraphs with clear topic sentences.  

    1) Rule-based reasoning (10 points): Under the statutory law of North Florida, can our client recover for the dog-bite?  Assume that the statute for dog-bite liability in North Florida has three elements: 1) defendant’s ownership of the dog; 2) injury caused by the dog; and 3) lack of provocation of the dog by the plaintiff.

    2) Analogical reasoning (20 points): Under the common law (case law) of North Florida, can our client recover for the dog-bite?  Use two of the cases described below.

    Case 1— A seven-year-old boy was on a neighbor’s porch, grabbing and pulling the ears of the neighbor’s dog and poking the animal in the stomach.  The boy was told several times by the neighbor to stop what he was doing and leave, but the boy continued until the dog bit him once on the cheek.  The court held that the dog’s owner was not liable for the damage caused by the dog because: (a) the boy had no right to remain on the neighbor’s property; (b) the dog had the right to defend itself; and (c) even though the boy was a minor, he still provoked the attack.

    Case 2— A three-year-old girl was playing jump rope on a neighbor’s front porch near the neighbor’s dog.  She accidentally jumped on the dog’s tail.  The dog yelped and scratched the girl on the leg with its front paws.  The court held that the dog’s owner was not liable for the damage caused by the dog because: (a) even an intentional acts can constitute provocation of a dog and (b) the attack was proportionate to the provocation.
