Week 1 Business

Is there Jurisdiction?

 

Look at the situations below and answer the question. Make sure to distinguish between subject matter and personal jurisdiction.  Additionally, discuss the standard the court will use to determine whether jurisdiction exists.  

 

 

Situation 1: Mike, a Utah resident, sues Jim, a Nevada resident for $60,000 in Nevada’s Federal District court for negligence (a state law civil suit).  Jim argues that the case should be dismissed for a lack of subject matter jurisdiction.  Is he right?  

 

 

Situation 2: Bill, a California resident, sues Bob, also a California resident, for copyright infringement, a cause of action arising under federal law, in a Federal District Court in California.  Bob argues that there is no subject matter jurisdiction. Is he right? 

 

  

Situation 3:  Billy, a Seattle, Washington resident, sues the Orange Corporation, a Texas corporation, under a breach of contract (a state law cause of action) in Washington State Court for $100,000.   The Orange Corporation does most of its business in Texas. It is incorporated in Texas, and its corporate Headquarters are located in Dallas, Texas. However, the Orange Corporation does have a branch office in Seattle, Washington where it employs a single salesman. Additionally, the corporation advertises in the Seattle.  The corporation argues that Washington lacks personal jurisdiction over the corporation. Is the corporation right? Assume for this question that Washington may exercise personal jurisdiction to the extent permitted by the Constitution of the United States.  Be sure to list the standard the court will apply.  

 

 

Situation 4: Same facts as above. Assume the court finds there is personal jurisdiction. Can the Orange Corporation have the case removed to federal court?   

 

 

The requirements below must be met for your paper to be accepted and graded:  

 

Write between 500 – 750 words (approximately 2 – 3 pages) using Microsoft Word.

Attempt APA style, see example below.

Use font size 12 and 1” margins.

Include cover page and reference page.

At least 60% of your paper must be original content/writing.

No more than 40% of your content/information may come from references.

Use at least two references from outside the course material, preferably from EBSCOhost.  Text book, lectures, and other materials in the course may be used, but are not counted toward the two reference requirement.

Reference material (data, dates, graphs, quotes, paraphrased words, values, etc.) must be identified in the paper and listed on a reference page.Reference material (data, dates, graphs, quotes, paraphrased words, values, etc.) must come from sources such as, scholarly journals found in EBSCOhost, online newspapers such as The Wall Street Journal, government websites, etc.  Sources such as Wikis, Yahoo Answers, eHow, etc. are not acceptable.

Environmental ATTN: Nightingale

Vector-Borne, Zoonotic, and Toxic Metal Risks Plagues, outbreaks, and disasters can have a catastrophic impact on health. Therefore, it is vital for environmental and public health practitioners to pay attention to the agents of environmental disease to prevent potential epidemics. During this week's Discussion, you analyze the vector-borne, zoonotic, and toxic metal concerns in your region. Additionally, you survey a range of concerns in the locations of your colleagues.  To prepare for this Discussion, read Chapters 5 and 6 of the course text. Review the PowerPoint presentations and the media presentation "Agents of Environmental Disease." Investigate the following websites:

  • Visit the website of your own state's department of public health and your county's local public health agency. Investigate health risks that are relevant to your region. Make sure to use only government and other reliable websites when researching information on environmental risks in your area.   
  • Review the National Center for Emerging Zoonotic and Infectious Diseases website. Find information regarding various health risks and what to do when faced with them.   
  • Review the Morbidity and Mortality Weekly Report (MMWR) website. Consider the methods that the CDC recommends for prevention of outbreaks and also some of the challenges faced.

By Day 4, post a brief description of one vector-borne risk, one zoonotic risk, and one toxic metal risk in your region. Describe some of the methods for controlling the risks you selected. Then, analyze how the risks in your area compare to those of a different location. Explain the similarities and differences. Finally, explain probable reasons for those differences.

Can you imagine an effective leader who is not an effective communicator? Leadership communication skills are very important. Some would call effective communication the most important leadership competency. Without the skills of effective communication, you will not be an effective leader, especially in this complex, fast-paced environment. 

It is important for the leader to create an environment of open communication where ideas, solutions, and problems can all be discussed without fear. When employees understand that communication is open and encouraged, they will perform better. 

Using the assigned readings, the Argosy University online library resources, and the Internet, research communication competencies required for leaders. 

Then, respond to the following:

• What are some key communication competencies needed in leaders today? 

• Is individual communication more important than group or mass communication? Why or why not? 

• List 2–4 strategies that leaders can use to improve their individual communication skills. Which method is most important? Why?

By Week 3, Day 3, post your response to the appropriate Discussion Area. Through Week 3, Day 7, review and comment on at least two peers’ responses.

Write your initial response in 300–500 words. Your response should be thorough and address all components of the discussion question in detail, include citations of all sources, where needed, according to the APA Style, and demonstrate accurate spelling, grammar, and punctuation

Our book discusses several disease states and their relation to nutrition like diabetes, cancer and hypertension. There are so many other diseases that benefit from nutrition management. Please choose a disease and write a 3 page, double spaced paper on how nutrition relates or plays a part in the management of that particular disease. Be sure to include a works cited (not included in the 3 pages).

The Evolving Cyber Security World

Write a 15 page (no longer) paper in which you identify and assess emerging cyber security approaches and technologies as well as discuss government efforts to nurture the development of these emerging technologies. An emerging technology is a technology that is in the genesis stage, is still researched and developed, and has not been proven, standardized, or widely adopted. By that criteria, fingerprint biometrics, eye biometrics, voice print ID as a class are all unacceptable topics.

The following two questions should be addressed in your paper.

1. How do the emerging cyber security technologies that you identified coupled with prioritized research and development improve cyber security?
A. Clearly defines the emerging cyber security technologies that you identify as well as their main features.
B. Clearly defines how an organization would use these emerging cyber security technologies.
C. Describes real-world examples of the use of these emerging cyber security technologies.
2. Discuss the role of federal government in the support and nurturing of emerging cyber security technologies that you identified.
A. Clearly discuss the benefits and drawbacks that government efforts to support new cyber security technologies may create.
B. Describe real-world examples that support your position.
