What standards of professional responsibility, if any, has DeFazio violated by her conduct in representing Squigman?

Squiggy Squigman retained attorney Laverne DeFazio to represent him on a federal bank robbery charge. The indictment charged that Squigman had robbed Milwaukee Bank on Shotz Street. The prosecutor’s case depended in part on photographic evidence obtained from hidden cameras in the bank. None of the photographs clearly depicted the robber’s face.

At their first meeting, Squigman told DeFazio that, at the time of the robbery, he was watching television at the home of his friend Shirley Feeney.

While reviewing the evidence, DeFazio noticed that one of the bank photographs showed the robber wearing a ring on the fourth finger of his right hand. Later, at one of their trial preparation sessions, DeFazio saw that Squigman had a ring on the same finger. DeFazio mentioned this to Squigman, and the following conversation occurred:

Squigman: So what? Lots of people wear rings on that finger and lots of rings look like this one.

DeFazio: Yours has a “B” on it.

Squigman: You can’t see the one in the bank photo clearly enough to see if there’s a “B” on that one.

DeFazio: You might be able to if they blow it up.

After the meeting ended, Squigman removed the ring and DeFazio never saw it again. In a subsequent meeting, DeFazio noticed a tan ring line on Squigman’s finger and said, “The DA may ask you about the ring line on your finger.” Squigman did not respond.

During the trial, but before he testified, Squigman asked DeFazio what he should do if the prosecutor asks him if he owned a ring with a “B” on it.

“If you insist on testifying, you have to tell the truth,” DeFazio said.

The night before closing arguments were scheduled to begin, Squigman gave DeFazio the balance of her legal fee in $100 bills. DeFazio noticed that the serial numbers on 14 of the $100 bills corresponded to the serial numbers identified during the testimony of a bank officer as the numbers on some of the stolen bills.

DeFazio returned all 14 of the $100 bills to Squigman and told him to bring an equivalent sum in other denominations. The following morning, Squigman came to court with bills in various denominations, which DeFazio accepted.

In her closing argument, DeFazio argued that the prosecutor was going after the wrong man and urged the jury to believe Shirley Feeney’s testimony confirming Squiggy’s alibi.

Java Project Automating A Mini-Golf Course (Design)

 

Description:

In this project, your team will put to use the skills you have learned for reading RFPs, creating detailed requirements and then a detailed design.  Either or both parts may be documented with text, unit tests, UML, or a combination of these.

Requirements:  The RFP

Carrying a pencil and score card when playing mini-golf is a pain; holding the club, ball, and trying to write the score down (with no table) is difficult.  A local mini-golf course chain has contracted your software development company to automate scoring.  At each hole is a keypad on a card-swipe station.  The customer hopes such high-tech mini-golf courses will attract more customers.

For cost reasons, the various courses around Tampa Bay all use the same central computer (already installed), connected to the card-swipe stations at each course using a network.  All the hardware has been installed already and the network is up and running.

Use-Cases and Other Requirements

The one use-case for the RFP is:

  1. The users are issued disposable (cardboard) swipe cards when they pay, before the round starts.  They provide their name when issued their card, which gets printed on the card.
  2. After completing each hole, the user swipes their card at that hole’s swipe station, and enters the number of strokes.  The card-swipe stations also display the player’s name and current score (the number of strokes over or under par, so far).  Once a score is entered for a hole, the player can’t change it.Note the score and the player’s name do not have to be stored on the swipe card itself.  That data can be kept (how is up to you) on the central computer.
  3. After playing the last hole, the play can turn in their swipe card and request a printout of their round (the score card).  (That usually has a discount coupon on the back, for next time.)

Process selection consists of determining the utmost appropriate method for task conclusion. It is a series of resolutions that contain technical or engineering problems and volume or scale issues. As Vonderembse and White (2013) stated, product design, capacity and process selection, are decisions that must be reflected on at the same time. The method for making a product must be contingent on the decisions made when designing a product. Likewise, the process selected and process technology impact product design. Simultaneous engineering was created in response to industrial challenges towards shorter lead times, lower costs and better customer satisfaction. In concurrent engineering, the dissimilar tasks in the product and production development process are integrated and performed concurrently rather than in sequence. Since the duties are being executed in parallel, by incorporating product and process design, this not only decreases the lead time but also improves quality. (Martin (2015). Furthermore, it leads to developing communication, decreases the number of variations in orders, evades delays and enables quick delivery of products thus preventing any mistakes that could increase costs (Vonderembse & White, 2013).  Martin (2015) further noted the prominence of taking into account, the stipulations of the products and the restrictions involved in the process during the design phase. By using the approach of Design for Manufacture, which combines the manufacturing information into the product during the product definition stage, many problems can be resolved (Martin, 2015).

Process selection is also related to the volume demanded in the market place. In process selection, managing leaders always aim to meet their goals by choosing the process that will best balance the costs, effectiveness, and quality. According to Ficko and Borojevic (2017), process forecasting is one of the most challenging tasks in product development because of a number of technological, economic and environmental issues. As a consequence, selecting a manufacturing process is considered a complex multi-criteria decision problem because it involves considering numerous possible alternative manufacturing processes (Fico & Borojevic, 2017). Capacity choices mandate careful deliberation of a business’s long-run goals and the market demand. These decisions must be dependable with existing and expected demand. So, based on the current or estimated market demand, corporations must choose the most suitable process to produce a good or service. The amount of capital put in production methods such as machinery should be warranted by the market demand for the product. If the demand is not enough to cover the cost of the machinery, then the organization should not invest in lavish, specialized equipment (Vonderembse & White, 2013).

The concept of process selection is inter-connected and closely related to a product’s design, along with the necessary capacity for having a seamless production to completion.  In order to properly design a product and maximize its effectiveness, it is vital to consider those three attributes simultaneously because they are directly linked, and they should never be done independently of each other(Vonderembse, & White, 2013).  The theory of process selection is concerned with the most appropriate method of completing a task based on technical, engineering or scale issues. The product design encompasses all the aesthetics needed to provide a viable and marketable product necessary to meet demands.  The capacity that is selected by the organization is based on the estimated demand of a product and the proper price point that consumers are willing to pay,

The type of operation that is needed by a company is contingent on the type of product that the business produces, and it is also correlated to the market demands, which is based on process selection that is a function of the volume demanded.  There are also different process types that encompass, different projects along with manufacturing cells, line flow, assemble line, batch, job shop and flexible manufacturing systems(Vonderembse, & White, 2013)
